Terms of Service

Last updated: [DATE]

DRAFT — for attorney review before publication. Bracketed items require a decision or a real value before this document is usable.

These Terms of Service ("Terms") govern access to and use of the DIY Pros mobile application and related services (the "Service"), operated by [COMPANY LEGAL NAME], an Indiana limited liability company ("DIY Pros," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What DIY Pros Is

DIY Pros is a marketplace that connects people seeking practical help ("DIY Users" or "you," when using the app in that role) with independent professionals ("Pros") across categories that currently include Auto Mechanics, Plumbing, Carpentry, Electrical, Makeup Artistry, and Music Production. Pros offer paid, live video or voice consultations through the app. DIY Pros is a technology platform that facilitates these connections and processes payment for them — DIY Pros does not itself provide auto repair, plumbing, electrical, cosmetology, or any other trade or professional service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By registering, you represent that the information you provide (name, email, and any other requested details) is accurate and that you will keep it current.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [SUPPORT EMAIL] if you suspect unauthorized use of your account. DIY Pros supports optional Face ID sign-in; your biometric data is processed entirely on your device by Apple's system frameworks and is never transmitted to or stored by DIY Pros — see the Privacy Policy for details.

4. Pro Verification — What We Check, and What We Don't

Before accepting live sessions, Pros must complete:

This knowledge assessment is not a professional license, and passing it is not a representation by DIY Pros that a Pro is licensed, insured, or legally authorized to perform any regulated trade in your jurisdiction. DIY Pros does not verify trade licenses, certifications issued by third-party bodies, or professional insurance, because no reliable, universal system exists to do so across every trade and every U.S. jurisdiction. Each Pro is independently responsible for holding whatever license, permit, or insurance their work and jurisdiction require, and for only offering advice they are legally and competently able to give. If you need work performed that legally requires a licensed contractor, you are responsible for independently verifying that license before relying on a Pro's advice for anything beyond informational purposes.

5. Sessions and Billing

6. Refunds and Disputes

7. Prohibited Conduct

You may not use the Service to:

DIY Pros monitors for patterns consistent with abuse (for example, an unusually high rate of sessions or refund requests in a short window) and may review, warn, suspend, or permanently terminate any account found to be abusing the Service, at our discretion.

8. Independent Contractor Relationship (Pros)

Pros are independent contractors, not employees, agents, or partners of DIY Pros. A separate Pro Agreement governs the terms of that relationship, including payment processing, fees, and termination. Nothing in these Terms creates an employment, agency, joint venture, or partnership relationship between DIY Pros and any Pro.

9. Disclaimers

THE SERVICE AND ANY ADVICE PROVIDED BY A PRO ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. DIY PROS DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR SAFETY OF ANY ADVICE GIVEN DURING A SESSION, AND IS NOT RESPONSIBLE FOR ANY ACTION YOU TAKE OR DO NOT TAKE BASED ON THAT ADVICE. FOR ANY SAFETY-CRITICAL WORK (INCLUDING BUT NOT LIMITED TO ELECTRICAL, STRUCTURAL, OR AUTOMOTIVE SAFETY SYSTEMS), YOU SHOULD CONSULT A LICENSED PROFESSIONAL IN PERSON BEFORE RELYING SOLELY ON REMOTE ADVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIY PROS' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO DIY PROS IN THE 12 MONTHS BEFORE THE CLAIM AROSE. DIY PROS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGE TO PROPERTY OR PERSONS ARISING FROM WORK PERFORMED BASED ON ADVICE RECEIVED THROUGH THE SERVICE.

11. Indemnification

You agree to indemnify and hold DIY Pros harmless from any claim arising from your use of the Service, your violation of these Terms, or (for Pros) the advice or services you provide to DIY Users.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service at any time.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. [PLACEHOLDER: decide whether disputes are resolved through binding arbitration, small claims court, or Indiana state courts, and specify venue — this is a material decision an attorney should help make, as it affects your ability to be sued in a class action.]

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after a change becomes effective constitutes acceptance of the revised Terms.
